Terms and Conditions of Sale

1. Seller Identification

These General Terms and Conditions of Sale (GTC) govern sales made on the website lowpact.com, operated by:

2. Scope of Application

These GTC apply to any order placed on the lowpact.com website by a consumer (a natural person of legal age acting for non-professional purposes). They supersede any other document, unless otherwise agreed in writing by Lowpact SRL.

3. Products

Lowpact SRL offers for sale homemade, organic, artisanal, and Belgian-origin meals. Products are described with the utmost care on the website. However, minor variations may exist between the photo and the delivered product, particularly due to the artisanal nature of the preparations.

Products are sold subject to availability. In case of unavailability after an order, the customer will be informed as soon as possible and may opt for a full refund or a credit note.

4. Prices

Prices are indicated in euros, all taxes included (TTC). Lowpact SRL reserves the right to modify its prices at any time. Orders are invoiced at the rate in effect at the time of order validation.

Delivery costs are indicated separately at the time of placing the order and are the responsibility of the customer, unless a contrary promotion applies.

5. Order

The order is validated upon effective payment. A confirmation email is sent to the customer upon validation. Lowpact SRL reserves the right to refuse or cancel any order in case of a dispute concerning a previous payment, suspicion of fraud, or a manifest error in the displayed price.

6. Payment

Payment is made online, at the time of ordering, via the payment methods offered on the website (credit card, etc.). Transactions are secured by the Shopify Payments platform. Lowpact SRL does not store any banking data.

7. Delivery

Orders are shipped via Bpost according to the following deadlines:

• Belgium: 1 to 2 business days
• France and Netherlands: 72 hours

These deadlines are indicative and run from the shipping confirmation. Lowpact SRL cannot be held responsible for delays attributable to the carrier. In case of a damaged or lost package, the customer is invited to contact Lowpact SRL at lowpact@gmail.com within 48 hours of delivery.

8. Right of Withdrawal and Returns

In accordance with Belgian and European legislation (Directive 2011/83/EU), the consumer has a period of 14 calendar days from receipt of their order to exercise their right of withdrawal, without having to provide a reason for their decision.

To exercise this right, the customer must notify their decision by email to lowpact@gmail.com, specifying the order number. Products must be returned in their original condition (unopened, unused, intact packaging). Return costs are the responsibility of the customer, unless the product is defective or does not match the order.

Upon receipt and verification of returned products:

• In case of withdrawal without a specific reason: full refund or credit note, at the customer's choice.
• In case of a defective product or order error on our part: priority full refund.

The refund will be made within 14 days following receipt of the return, via the same payment method used during the order.

Exception: In accordance with Article VI.53 of the Belgian Code of Economic Law, the right of withdrawal does not apply to perishable goods or goods likely to deteriorate rapidly, nor to products unsealed after delivery that cannot be returned for reasons of hygiene or health protection.

9. Legal Guarantees

Any product sold by Lowpact SRL benefits from the legal guarantee of conformity (articles 1649bis et seq. of the Belgian Civil Code) as well as the guarantee against hidden defects. In case of non-conformity noted upon receipt, the customer must contact Lowpact SRL as soon as possible.

10. Liability

Lowpact SRL cannot be held responsible for indirect damages resulting from the use of products, nor for delays or non-performance due to force majeure. The liability of Lowpact SRL is in any case limited to the amount of the order concerned.

11. Personal Data

Personal data collected during the order is processed in accordance with the Privacy Policy available on the website.

12. Applicable Law and Dispute Resolution

These GTC are subject to Belgian law. In case of dispute, an amicable solution will be sought first. Failing that, the competent courts are those of the jurisdiction of Lowpact SRL's registered office.
